  • The Assault on the 10th Amendment

    This is what the 10th Amendment says – “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

    What does this mean to you? Do you see that our Federal government is overstepping their powers by taking over duties and responsibilities that the Constitution says are reserved for the States and the PEOPLE? Why doesn’t this outrage the tax payers? Why isn’t this reported on the so-called “news”?

    The Federal government’s powers are strictly limited by the 10th Amendment. The Constitution does not include a provision for Congressional power to override State laws. It does not give the Judicial Branch unlimited jurisdiction over all matters. It does not provide Congress with the powers to legislate over everything. This is verified by the very fact that attempts to make these principles part of the Constitution were soundly rejected by the founders.

    If Congress had been intended to carry out anything and everything they claimed to was for the “good of the people” and to promote the “general welfare” of the people – what then would be the point of listing their specific powers in Article I Section 8 – since these actions would have already been covered? The founding fathers were smart to this situation – they just went through it.

    During the Constitution ratification process, James Madison presented the Virginia Plan – as a guide to how much power Congress should have (giving them unlimited powers) – but this plan was soundly rejected by all of those on hand. He also made many more attempts to authorize a national veto over state laws – but this was voted down every time it was brought up.

    The 10th Amendment was adopted to emphasize the fact that the States shall remain individual and unique sovereignty’s. Thus any Federal attempt to legislate beyond the Constitutional limits of Congress’ authority is clearly a usurpation of sovereignty and is ILLEGAL! Yet the Obama administration pushes this envelope every day.

    The main reason for this clause in the Constitution was that the signers and the people of the time had just gone through a situation where they had barely escaped the tyranny of a King who thought he knew best how to govern everything – sound familiar? This is why the 10th Amendment came to be – to PREVENT this from ever happening again – especially on American soil to Americans.

    Government and political leaders are best held accountable for their actions when the government is LOCAL. Not some giant behemoth government that is out of reach and touch with the people. The people of a given state know what is best for them – they don’ t need an all knowing Federal government – filled with bureaucrats who want to govern them from thousands of miles away.

    Since there have been actual incursions against State rights why haven’t the courts challenged this? Why hasn’t the Judicial Branch of the government challenged this – like it says in the Constitution? Why is our government throwing away the Constitution?

    This is why this country is heading down the road to Socialism right now – and why no one is stopping those in power – the Constitution is dead right now – and it is our responsibility as the tax paying people of this country to bring it back from the dead. Please sign in and be counted as an American for the Constitution. Our rights are slowly being taken away from us. The 2nd, 9th and 10th Amendments are slowly dissolving – and it is only the people – the will of the people – that can stop this grave injustice.
